Open Source and Proprietary Intellectual Property– Making them work in harmony to maximize Company Value
 

Abstract

In modern day, open source is now vital to development cycles and competitive products of nearly all companies that use or provide software. Many companies now use as well as contribute to numerous open source initiatives, despite the effects it can have on their own intellectual property (IP). In this presentation, we will look at the different patent clauses in different OS licenses and what they each mean.  We will also review the potential effects of specific OS license terms on a licensee’s patents, and how to manage OS usage and maintain proprietary IP protection.  A survey of recent lawsuits related to open source will be discussed along with the key take-aways from each one.  Finally, a review of the best practices for contributing to an open source initiative while maintaining the integrity of your patent portfolio.
